1. Acceptance of these Terms
By creating an account or using the Navikin app, you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not use the service.
These Terms form an agreement between you and Navikin Inc (“Navikin”, “we”, “us” or “our”).
Navikin is currently available only to users in Australia.
2. About the service
Navikin is a personalised workflow tool that helps families organise and track the administrative tasks that arise when a parent’s circumstances change. It sequences tasks, remembers what has already been done, and provides plain-English guidance on next steps.
Navikin is a coordination and checklist tool. It is not a professional advisory service.
3. Important limitation – No professional advice
This is the most important section of these Terms.
Navikin does not provide legal, financial, medical, tax, aged-care or any other professional advice. Nothing in the app should be treated as a substitute for advice from a qualified professional.
- Lawyers remain lawyers.
- Doctors remain doctors.
- Banks, government agencies and aged-care providers remain the authoritative sources for their own processes.
You are solely responsible for verifying any information with the relevant professional or government agency before acting on it. Navikin’s role is to help you stay organised and reduce uncertainty — not to make decisions for you.
4. Your account
You must provide accurate information when creating an account and keep your login details secure. You are responsible for all activity that occurs under your account.
You must be at least 18 years old to use Navikin.
You may delete your account at any time. When you do, we will delete or de-identify your personal information in accordance with our Privacy Policy, subject to any legal retention requirements.
5. Acceptable use
You agree to use Navikin only for lawful purposes and in a way that does not harm the service or other users. You must not:
- Attempt to gain unauthorised access to the service or related systems
- Use the app to store or transmit unlawful content
- Reverse-engineer, scrape or misuse the service
- Impersonate another person or misrepresent your relationship to a parent
We may suspend or terminate access if we reasonably believe these rules have been breached.
6. Intellectual property
Navikin and its content (including the workflow structure, text, design and software) are owned by Navikin Inc or its licensors. You may use the service for your personal, non-commercial purposes only. You may not copy, modify, distribute or create derivative works from the service without our prior written permission.
7. Disclaimers
The service is provided on an “as is” and “as available” basis. While we aim to keep information accurate and the service reliable, we do not guarantee that:
- The workflow or task lists will be complete for every possible situation
- The service will be uninterrupted or error-free
- Any particular outcome will result from using the app
Because family situations and government processes change, you should always confirm current requirements with the relevant authority or professional.
8. Limitation of liability
To the maximum extent permitted by law (including the Australian Consumer Law), Navikin Inc and its officers, employees and agents will not be liable for any indirect, incidental, special or consequential loss, or for any loss of data, opportunity or profits, arising from your use of the service.
Where liability cannot be excluded under Australian Consumer Law, our liability is limited to re-supplying the service or paying the cost of re-supply, at our option.
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded.
9. Termination
You may stop using Navikin at any time by deleting your account.
We may suspend or terminate your access if you breach these Terms or if we need to do so for legal or operational reasons. We will provide notice where it is reasonable to do so.
10. Governing law
These Terms are governed by the laws of California, United States, except that the Australian Consumer Law continues to apply to you as an Australian consumer and cannot be excluded.
Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of California, without limiting any rights you have under Australian Consumer Law.
11. Changes to these Terms
We may update these Terms from time to time. The latest version will always be available in the app and on our website. If we make significant changes, we will notify you through the app or by email. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
